DABT Proposes to Repeal Administrative Rule Regarding Keg Deposits

On July 5, 2016, DABT published Notice of a Proposed Rule. The current Rule, 61A-4.0131, regulated keg deposits and records regarding them between distributors and retailers of malt beverages sold in reusable containers, usually ‘kegs’. Effective July 1, 2016, Fla. Stat. Sec. 561.4205 codified the basic principals of the Rule and expanded it to include all alcoholic beverages that are sold to retailers in reusable containers. The statute also provided for a system of inventory controls of the reusable containers in lieu of charging retailers a deposit. As a result of the statutory enactment, the Rule is no longer necessary.
